These Terms and Conditions of Use apply to all Gift Cards purchased from The Federal Hotels Pty Ltd ABN 45 004 108 249 (Federal Group) after 3 June 2024.

YOUR PURCHASE OF GIFT CARDS CONSTITUTES YOUR ACCEPTANCE TO BE BOUND BY THESE TERMS AND CONDITIONS AND AGREEMENT TO OUR PRIVACY POLICY.

These are the terms and conditions for your purchase of Gift Cards. Please read this document carefully before proceeding with your purchase.

2. DEFINITIONS

"Federal Group" means The Federal Hotels Pty Ltd ABN 45 004 108 240 of 410 Sandy Bay Road, Sandy Bay Tasmania 7005, and its related entities.

"Gift Card/s" means the Gift Cards that you are purchasing.

A reference to "we" or "us" or “our” is a reference to Federal Group.

A reference to "you" or "your" is a reference to the person who is purchasing Gift Cards using this website.

3. USE OF THIS WEBSITE

3.1 Acknowledgement
You acknowledge that we may allow access to the services offered on this website to anyone who enters the website and uses your login details consisting of a valid and active username and password. Your login details are our way of identifying a user and providing access to the Federal Group Corporate Sales Gift Card Service.

3.2 Indemnity
You are responsible for the use of this website and service including anyone who uses it in connection with your corporate account and your login details. You indemnify us in respect of all use of this website by you, with your consent or in connection with your Gift Card ordering, except to the extent that we have expressly authorised that use.

You and your organisation are solely responsible for any loss caused by use of your login details by you or any other person, including any use not approved or contemplated by you.

You will not change, hack into or otherwise interfere with the operation of this website or any information contained within it.

You must notify us immediately by emailing FGTGiftCards@federalgroup.com.au if you know of or suspect any unauthorised use of this website and service, including unauthorised access utilising your login details.

3.3. Withdrawal or suspension of service
Our online services, or your access to them, may be withdrawn or suspended for any reason without notice, including but not limited to the following;

• any interruption to, or fault in, any applicable computer or telecommunications system or service including if a service, website computer or telecommunications system is subjected to any virus, unauthorised access, or similar event;
• for website maintenance or security purposes;
• if you breach any of these terms and conditions or use the service for a purpose not expressly authorised by Federal Group under these terms and conditions or otherwise in writing;
• if your login consisting of a valid and active username and password is disabled, suspended, cancelled or expires; or
• if Federal Group no longer wishes to provide the service or maintain this website.

3.4 Intellectual Property
The website and its contents are subject to intellectual property rights. These intellectual property rights may be owned by Federal Group or third parties.

You may view this site and its contents using your web browser and electronically copy and print hard copies of parts of this site solely for personal, non-commercial use. Any other use, including the reproduction, modification, distribution, republication, display, communication or performance, of the content of this site is strictly prohibited.

3.5 Viruses and Cookies
Federal Group cannot guarantee that any file or program available for access, download and/or execution from or via this website is free from viruses or other conditions that could damage or interfere with data, hardware or software with which it might be used. You assume all risk associated with the use of all programs and files on this website and you release Federal Group entirely from all responsibility and any consequences of its use.

3.6 Security
When you provide us with your personal data (including your name, address, and credit card number) through the ordering process, we protect your personal data in transit by a Secure Socket Layer (SSL), which fully encrypts your personal data from being read by anyone over the internet. SSL encryption works by forming a matched pair with the transmission from your computer transmission and our server, so that only data to and from these sources is valid. 4. PURCHASING GIFT CARDS

4.1 Payment
You may pay for your Gift Card value with any Australian tender, other than with a Gift Card. The transaction will be completed when the Gift Card is activated and loaded with value.

There may be a delay with the Gift Card activating in the system once loaded. During this delay, the Gift Card cannot be used for purchases or transaction enquiries.

4.2 Use of purchased Gift Cards
All Gift Cards purchased through this site are to loaded, redeemed, used and subject to the Terms and Conditions of Gift Card Use.

4.3 Expiry of Gift Cards
Gift Cards will be valid for use for 3 years from the date of issue (or as otherwise extended by us), after such time it will be invalid and any remaining balance will be forfeited.

4.4 Cancellation and voiding of Gift Cards

1. Gift Cards cannot be cancelled once they are issued except if voided by Federal Group, if their value is used or if they expire.
2. We reserve the right to void any Gift Card that appears to have been defaced, mutilated, altered or tampered with in any way and Federal Group may subject Gift Cards to a verification process.
3. We reserve the right to cancel any Gift Card, or the Gift Card program, for any reason at any time without notice. In such instances (except those set out in paragraph b) we will elect to provide a refund or a replacement Gift Card.
4. We reserve the right to correct the balance of Gift Cards if we believe that a clerical or accounting error has occurred.

4.5 Re-issue of faulty or damaged Gift Cards
Defaced, mutilated, altered or damaged cards will not be replaced, refunded or redeemed.

4.6 Lost or stolen Gift Cards
Lost or stolen Gift Cards will not be replaced or refunded. The bearer of the Gift Card will be taken to be the owner of the Gift Card.

5. PRIVACY AND CONFIDENTIALITY

Protecting your privacy and the confidentiality of your personal information is fundamental to the way Federal Group does business.

6. DISCLAIMER

You agree that your access to, and use of, this website is subject to these terms and conditions and all applicable laws and is at your own risk. You acknowledge that this website and its contents are provided on an "as is" basis. This website may contain errors, faults and inaccuracies and may not be complete and current.

Federal Group makes no representations or warranties of any kind, express or implied, concerning the operation of this website, or any information, content, materials or products included on this site or related to this site, except as otherwise required under applicable laws. We reserve the right to change any of the terms contained in these Terms and Conditions at any time where the change is required for any reason. 8. LIMITATION OF LIABILITY

You have certain rights under the Australian consumer legislation which cannot be excluded and are not affected by these terms and conditions. Except for those statutory rights, any conditions implied by any other laws are excluded from these Terms and Conditions. To the maximum extent permitted by law, Federal Group will not be liable to you for any loss or damage (whether direct, indirect or consequential) howsoever caused, nor will we be in default under these Terms and Conditions, for failure to observe or perform any of our obligations under these Terms of Use for any reason or cause except if caused by our gross negligence. To the extent permitted by law, if we are liable to you, our maximum aggregate liability to you is limited, at our option to the supply of the goods or services again or payment of the cost of having the goods or services supplied again.

9. APPLICABLE LAW

These Terms and Conditions are governed by the law of Tasmania, and the parties submit to the non-exclusive jurisdiction of the courts of Tasmania.

This website may be accessed throughout Australia and overseas. Without limiting the above disclaimer, Federal Group makes no representations that the content of this website complies with the laws (including intellectual property laws) of any country outside Australia. If you access this site from outside Australia, you do so at your own risk and are responsible for complying with the laws in the place where you access the site.
